What Can I Do About a Dispute Over a Neighbour’s Tree?

b2ap3 large neighbours tree

Everybody needs good neighbours. But relationships with even the best neighbours can become strained over disputes concerning trees and hedges. Often the potential for matters to get out of hand is because the parties do not understand their rights and responsibilities. At Szabo & Associates, we can advise you on the things you need to know whichever side of the fence you find yourself on.

Hopefully, a clear understanding of these rights and responsibilities will have the desired effect in clearing the way to an amicable resolution. It is best that the issues are resolved in this way, but, if not, it is important not to take matters into your own hands as serious penalties can result.

In some situations, the only option left to resolve the dispute is to take the matter to court. The NSW Land and Environment Court has jurisdiction over a wide variety of matters, including tree disputes arising under the Trees (Disputes Between Neighbours) Act 2006. Our advice can guide and assist you in applying to the Land and Environment Court for an order for remediation or prevention.
